Eligible entities include for-profit businesses, nonprofit organizations, producer-owned cooperatives, certified benefit corporations, Indian Tribes, Tribal organizations, and State or local governments. To be eligible, entities must be physically located in the United States, comply with relevant regulations, and not hold a market share exceeding the fourth-largest market share for nitrogen, phosphate, or potash. The Secretary will prioritize projects that improve fertilizer production methods, dedicate capacity to U.S. agricultural commodity production, or improve competition and reduce fertilizer prices. Eligible activities include building or purchasing facilities, covering predevelopment costs, providing working capital, modernizing facilities, purchasing equipment, reducing emissions, ensuring legal compliance, and workforce development. Grants under this section may not exceed $100,000,000, and recipients must provide matching funds equal to the grant amount. Loan terms and conditions will generally align with those of existing business and industry loans under the Consolidated Farm and Rural Development Act. Projects can last up to 5 years, with potential extensions at the Secretary’s discretion. The Secretary is directed to supplement, not supplant, existing funds and coordinate with other agencies. Recipients must repay grants or loans if ownership of the project or assets is transferred to an entity with a large market share within 10 years of project completion.
