This section amends the Social Security Act to address unemployment compensation for excepted federal employees during a lapse in appropriations. State unemployment compensation laws must allow excepted federal employees performing emergency work during a lapse in appropriations in fiscal years 2026 or 2027 to apply for and receive unemployment compensation. If an excepted federal employee receives pay under section 1341(c)(2) of title 31 and also receives unemployment compensation, they must repay the unemployment compensation to the state. Any unrepaid compensation is treated as an overpayment, and the state can recover it. The Secretary of the Treasury will pay states an amount equal to 100% of unemployment compensation provided to excepted federal employees and any related administrative expenses. Funds for these payments will be drawn from the Unemployment Trust Fund. An 'excepted Federal employee' is defined as an excepted employee not being paid due to a lapse in appropriations.
