Employees cannot lose any employment benefits accrued before taking leave for voting purposes. Employers are prohibited from interfering with, restraining, or discriminating against employees for taking or attempting to take voting leave. The Secretary of Labor has investigative authority regarding this section, similar to the Family and Medical Leave Act. Employers violating this Act may be subject to civil penalties not to exceed $10,000 per violation. The size of the business, the gravity of the violation, the employer’s good faith, and the history of previous violations will be considered when assessing penalties. The term 'employee' is defined according to the Fair Labor Standards Act, and 'employer' applies to those employing 25 or more employees during a calendar year. This Act does not supersede State or local laws that provide more generous voting leave provisions.
