This section requires employers to provide a minimum of 2 consecutive hours of paid leave to employees upon request to vote in a Federal election, return a ballot, or perform other voting-related activities. Employers may specify the hours during which an employee can take leave, including designating early voting periods, but lunch breaks cannot be included in the 2-hour period. Taking leave under this section cannot result in the loss of any employment benefits accrued prior to the leave. It is unlawful for employers to interfere with, restrain, or discriminate against employees for taking leave under this Act. The Secretary of Labor has investigative authority regarding this section, similar to the Family and Medical Leave Act of 1993. Employers who violate this Act may be subject to civil penalties not to exceed $10,000 per violation. The definition of 'employee' aligns with the Fair Labor Standards Act of 1938, and 'employer' applies to those employing 25 or more employees during a calendar year. This Act does not supersede State or local laws that provide greater leave requirements or more beneficial terms for employees regarding voting.
