Executive agencies cannot solicit offers, award contracts, or consent to subcontracts with entities listed as ineligible. It is unlawful to knowingly fail to make the required representations or certifications, subject to suspension and debarment proceedings and penalties under the False Claims Act. The Secretary must submit annual reports to Congress detailing the number of entities on the list, those agreeing to corrective measures, contract amounts, and an assessment of the Act's effectiveness.
