What does CLARIFICATION OF FEDERAL JURISDICTION OVER LARGE LOAD of POWER Up Act do?

This section amends the Federal Power Act to establish federal jurisdiction over the interconnection of large load facilities. A 'large load facility' is defined as any facility or group of facilities with a projected aggregate peak electricity demand of 100 megawatts or greater, subject to adjustment by the Commission. The Commission has jurisdiction over the interconnection of large load facilities to transmission facilities used in interstate commerce. Such interconnections are subject to sections 205 and 206 of the Federal Power Act and are considered a component of open access transmission service. The Commission must issue a final rule within 18 months of enactment establishing standardized procedures and agreements for interconnection, including for hybrid facilities. The rule must also include a test for transmission facilities to aid in interconnection. This section preserves the authority of states and local governments over facility siting, permitting, construction, retail electric service, local distribution, and generation.
