An exception to the prohibition exists for vehicles not intended for public roads and brought in solely for testing and evaluation by a U.S.-based entity that does not have ties to a covered country. The Commissioner of U.S. Customs and Border Protection, in consultation with the Secretary of Commerce, can issue authorizations for vehicles otherwise prohibited, requiring a risk assessment and Congressional notification. The Secretary of Commerce must publish a list of authorized connected vehicles, including details about why they do not pose a risk, by January 1, 2027. Manufacturers can request authorization for their vehicles starting January 1, 2027. Regulations implementing this section, including a list of prohibited vehicles, must be published within 90 days of the Act's enactment. The prohibition takes effect 30 days after the regulations are published in the Federal Register.
