A 'covered consultancy' is defined as a company that, within a five-year period, has failed to disclose information, submitted false information, or failed to disclose conflicts of interest related to 'covered entities'. Covered entities include the governments of China and Russia, entities on specific U.S. government lists, and other entities determined to be foreign adversaries. Consultants offering services to the Department of Defense must disclose any relationships with covered entities. Failure to disclose such relationships can result in contract termination and debarment for up to five years. Companies can seek certification that they are no longer covered consultancies by demonstrating they no longer have relationships with covered entities. The Secretary is required to issue policies and guidance to implement the prohibition and revise the Defense Federal Acquisition Regulation Supplement within specified timeframes.
