A 'marginal well' is defined as an oil or natural gas well site with low average daily production, specifically 15 barrels of oil per day or less, or 15 barrels of oil equivalent per day or less, or 90,000 cubic feet of natural gas per day or less. The exemption includes standards of performance, guidelines, monitoring, reporting, recordkeeping, fugitive emission surveys, leak detection and repair, and emissions estimation. The Administrator of the Environmental Protection Agency (EPA) cannot require state plans to include standards applicable to marginal wells. If a state revises its plan to exclude marginal wells, the EPA must act on the revision within 180 days; failure to act results in deemed approval. The EPA is required to revise regulations and guidance within 180 days of the Act's enactment to implement the new exemption. Pending enforcement actions related to marginal wells are to be terminated.
