What does TRAINING AND COMPETENCY EVALUATION PROGRAMS. of Ensuring Seniors’ Access to Quality Care Act do?

This section amends sections 1819(f)(2) and 1919(f)(2) of the Social Security Act related to nurse aide training and competency evaluation programs. It establishes a process for the Secretary of Health and Human Services to disapprove nurse aide training programs in skilled nursing facilities or nursing facilities if they have been assessed a civil monetary penalty of at least $10,697 for substandard quality of care and have not corrected the deficiencies. Disapproval can last up to two years and can be rescinded if the facility demonstrates it has remedied the deficiencies, has not received deficiencies related to direct patient harm in the prior two years, and the civil monetary penalty did not result in immediate jeopardy. The Secretary may require additional oversight during the rescission period. The Secretary is required to promulgate regulations within 180 days of the Act's enactment to implement these changes. Amendments in subsections (a)(4) and (b)(4) apply only to civil monetary penalties where the relevant determination was made on or after the date of enactment. Existing prohibitions under certain sections of the Social Security Act no longer apply to facilities on the date of enactment, with some exceptions requiring a determination by the Secretary.
