This section amends title 49 of the United States Code by adding section 42309, concerning protections related to frequent flyer programs and co-branded credit cards. Covered air carriers must prominently display the financial value of points, miles, or other accrued values on their websites and mobile applications, updating this information in real time. Frequent flyer programs are prohibited from placing expiration dates on points, miles, or other accrued values. Consumers are allowed to transfer points, miles, or other accrued values to other participants of the same program, with the value remaining equal. Air carriers cannot impose fees or penalties for accessing, using, redeeming, or redepositing points, miles, or other accrued values. Air carriers must display airfare and ancillary fee costs in both dollar value and points/miles value. Air carriers must offer consumers the ability to purchase airfare or ancillary fees using a combination of dollars and points/miles. Covered air carriers must require multi-factor authentication for frequent flyer program account access. Air carriers are restricted from making changes to terms of service without providing consumers at least one year’s notice. The Secretary shall coordinate with the Director of the Consumer Financial Protection Bureau and the Commissioners of the Federal Trade Commission in implementing these provisions.
