What does ADDRESSING STOLEN SENSITIVE DATA. of Protecting Stolen Encrypted Data Act of 2026 do?

This section defines key terms including 'classified information,' 'covered data,' and 'United States person' for the purposes of addressing stolen sensitive data. The President, through the Secretary of Defense and the Director of National Intelligence, is directed to develop strategies to identify covered data and classified information unlawfully held by foreign entities, including whether the data is encrypted and decrypted. The President must also develop strategies to address stolen covered data and classified information. The Secretary of Defense and the Director of National Intelligence jointly determine if destroying, manipulating, or recovering identified data is in the economic and national security interest of the United States. If such action is deemed in the interest of the United States, they may attempt to destroy, manipulate, or recover the data, and inform the lawful owners when practicable. Within one year of the Act's enactment, the Secretary and the Director must submit a report to Congress detailing the strategies developed and actions taken. The report to Congress should include recommendations for legislative or administrative action.
