What does LIMITATIONS ON USE OF ARTIFICIAL INTELLIGENCE BY DEPARTMENT OF of AI Guardrails Act of 2026 do?

This section expresses a sense of Congress that the Department of Defense (DoD) should aggressively adopt artificial intelligence (AI) to maintain global military preeminence, while ensuring its use is secure and reliable. The DoD is prohibited from using AI to launch or detonate nuclear weapons. The DoD is restricted from monitoring, tracking, profiling, or targeting individuals or groups within the United States without an individualized, articulable legal basis, and cannot use AI to target First Amendment activities. The DoD is prohibited from employing lethal force with autonomous weapon systems without appropriate human judgment and supervision, consistent with Department of Defense Directive 3000.09. The Secretary of Defense can waive the prohibition on lethal force by autonomous weapon systems for up to one year, renewable for another year, under extraordinary national security circumstances. Waivers require a written certification to congressional defense committees and are subject to specific notification requirements to Congress, including rationale, system description, operational parameters, and safeguards. Notifications regarding waivers must be submitted within five days of waiver issuance, fielding, or significant system modifications. The term 'artificial intelligence' is defined by reference to section 5002 of the National Artificial Intelligence Initiative Act of 2020.
