This section amends title 32 of the United States Code to establish a new section, 328a, concerning Active Guard and Reserve (AGR) duty for state disaster response. A state's chief executive, after declaring an emergency, may order AGR members to perform duties related to a disaster with the consent of the Secretary of Defense. State disaster response duty is performed on a reimbursable basis, with costs charged to the state or other non-Federal funds. The duty is initially limited to 14 days per member per calendar year, but the Secretary of Defense may authorize extensions of up to 7 or 46 days under specific conditions. The Secretary of Defense can authorize duty beyond the initial 14-day limit if requested by the chief executive. If a state is more than 90 days in arrears on reimbursement, further duty may be restricted unless authorized by the Secretary of Defense and funds are obligated. While performing this duty, National Guard members are not considered instruments of the United States, and the U.S. is not responsible for claims arising from their actions.
