This section amends Chapter 53 of Title 49 of the United States Code to allow transit agencies to assume responsibility for determining whether certain activities are categorically excluded from environmental assessments or impact statements. To be eligible, a transit agency must be located in an urbanized area with a population of over 200,000 and demonstrate legal, technical, and financial capacity. The Secretary may assign these responsibilities, and eligible recipients may assume them, according to criteria established by the Secretary, including provisions for public availability of information. Eligible recipients may also assume responsibilities for complying with other Federal laws related to categorical exclusions, with the Secretary having no responsibility or liability in such cases. Memoranda of Understanding (MOUs) will be established between the Secretary and eligible recipients, outlining responsibilities and terms, and are generally renewable every 3 years (or 5 years for recipients with 10+ years of experience). The Secretary will monitor compliance with MOUs and provide technical assistance to eligible recipients. The Secretary can terminate an eligible recipient’s responsibilities if they fail to adequately carry out assigned duties, after providing notification and a period for corrective action. Eligible recipients assuming responsibilities are deemed Federal agencies for the purposes of the Federal law under which the responsibility is exercised. Funds apportioned to eligible recipients may be used for attorney's fees directly attributable to eligible activities associated with a specific project.
