What does PREVENTION OF PERSON WHO HAS BEEN CONVICTED OF A MISDEMEANOR of Disarm Hate Act do?

This section amends title 18, United States Code, sections 921 and 922 to restrict firearm access for individuals convicted of misdemeanor hate crimes or who received enhanced sentences due to hate or bias. It defines 'convicted in any court of a misdemeanor hate crime' as a misdemeanor conviction involving hate or bias motivated conduct and the use or threat of physical force. The definition excludes convictions without legal representation or jury trials unless certain waivers occurred. It also defines 'received from any court an enhanced hate crime misdemeanor sentence' as a sentence based, in whole or in part, on a judicial finding of hate or bias motivation. Similar exclusions apply to enhanced sentences as to misdemeanor hate crime convictions regarding legal representation and jury trials. Expunged convictions or pardons are excluded if they do not expressly prohibit firearm possession, shipment, or receipt. Section 922(d) is amended to prohibit the sale or other disposition of a firearm to individuals meeting the defined criteria. Section 922(g) is amended to prohibit possession, shipment, or transport of a firearm by individuals meeting the defined criteria.
