What does MANDATORY ORIGIN AND LOCATION DISCLOSURE FOR NEW PRODUCTS OF of COOL Online Act do?

This section establishes requirements for disclosing the country of origin and the seller's principal place of business for products of foreign origin offered for sale on the internet. It is unlawful to introduce, sell, advertise, or offer for sale such products without conspicuous disclosure of this information. Certain products are excluded from these requirements, including agricultural products, food and drugs under FDA jurisdiction, used or previously-owned articles, and goods listed by small sellers (with annual sales under $20,000 and fewer than 200 discrete sales). Manufacturers, importers, distributors, sellers, suppliers, or private labelers are obligated to provide the required information to retailers. Retailers can satisfy the disclosure requirements if the information is provided by a third party, creating a 'safe harbor'. Violations of this section are treated as violations of the Federal Trade Commission Act and are enforceable by the Federal Trade Commission. The Federal Trade Commission, U.S. Customs and Border Protection, and the Department of Agriculture are required to enter into an agreement for consistent implementation within six months of enactment. Retailers are not liable if they relied on a false or deceptive representation from a third party regarding the product's origin and took immediate corrective action.
