This section amends title 10, United States Code, by adding sections 3709 and 3710. Offerors are required to report to the contracting officer if the price of a product or service under a covered contract reaches or exceeds 25 percent above the contract bid price or the government's previous year's price. Offerors must also report if the price exceeds 50 percent above the price paid five years earlier. A 'covered contract' is defined as a contract awarded without competition under section 3204 or as defined under section 6.302 of the Federal Acquisition Regulation. The Director of the Defense Contract Audit Agency or the relevant service acquisition executive must report noncompliance information to the Federal Awardee Performance and Integrity Information System (FAPIIS). FAPIIS reporting includes contractors who fail to report price increases, audit findings regarding noncompliance, and details of unreported price increases such as National Stock Number, order quantity, unit cost, total cost, purchasing entity, and order date.
