It defines 'age discrimination dispute' as a dispute relating to conduct alleged to constitute age discrimination against a person who is not less than 40 years of age, including disparate treatment, disparate impact, harassment, and retaliation. Predispute arbitration agreements and predispute joint-action waivers are defined by reference to section 401. The section establishes that, at the election of the person alleging age discrimination, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a case filed under Federal, Tribal, or State law.
