The Program will be administered by the Secretary of the Army and will be part of the Defense Industrial Resilience Consortium. The Secretary shall leverage alternative acquisition mechanisms, including other transaction authority and the middle tier of acquisition pathway. The Program consists of two components: a Government-owned innovation facility operated by the United States Army Materiel Command and a Government-owned production facility with the capability to produce 1,000,000 small unmanned aircraft systems annually. The Secretary may utilize contractor augmented support and public-private partnerships to support the Program. The Program will prioritize utilizing or modifying existing Army Depot facilities, selecting at least two sites for the innovation and production facilities. The production facility must be located at an existing Army Depot comprising 15,000 acres of land, with approximately 10,000 buildable acres and 8,000,000 square feet of facilities, located within 50 miles of four states. The Secretary shall ensure the United States retains intellectual property and technical data rights for systems developed under the Program. The President (or the Secretary of Defense) shall utilize authorities under Title III of the Defense Production Act of 1950 to prioritize and support domestic industrial base capacity for small unmanned aircraft systems. The Secretary may expedite or waive Department of Defense regulatory requirements to facilitate the Program's activities.
