An 'artificial system' is a data system or software using AI, but excludes common commercial products like word processors. ’Emerging artificial intelligence technology’ refers to systems with performance, complexity, or autonomy comparable to or exceeding state-of-the-art capabilities at the time of a security vulnerability. ’Covered individual’ includes employees and independent contractors. ’Employer’ is defined broadly to include entities engaged in commerce who compensate covered individuals.

Waivers of rights or remedies, including arbitration agreements, are not enforceable under this section.
