This section establishes the Michael Enzi Voluntary Protection Program (Program) within the Department of Labor. The Program recognizes employers committed to comprehensive safety and health management systems, including hazard assessment, prevention, and employee training. Employers seeking participation must submit applications and conduct annual self-evaluations, followed by onsite evaluations by the Secretary of Labor. Onsite evaluations will not result in enforcement citations, and any identified hazards must be corrected within 90 days. Employers participating in the Program must make safety and health program information readily available to the Secretary of Labor and employees. The Secretary of Labor is required to modernize technology for administering the Program, including the application process and self-evaluation submissions. Worksite audits and evaluations will be supervised by Occupational Safety and Health Administration employees and special Government employees. The Secretary of Labor must develop a documentation policy for follow-up actions related to fatalities and serious injuries at participating worksites. Participating worksites are exempt from programmed inspections. The Secretary of Labor is prohibited from requiring payments for employers to qualify for or participate in the Program. The Secretary of Labor shall use not less than 5 percent of funds appropriated for the Occupational Safety and Health Administration to carry out this Act.
