This section outlines procedures for the Federal Aviation Administration (FAA) in the event of a lapse in appropriations. If an appropriation measure or continuing resolution is not enacted before the start of a fiscal year, the FAA Administrator can utilize funds from the Airport and Airway Trust Fund to continue programs, projects, and activities. These continued operations will be at a rate not exceeding that provided in the previous year's regular appropriation Act or a prior continuing resolution. The availability of these funds extends from the start of the lapse until the enactment of a regular appropriation bill or a continuing resolution. The funding will be subject to the terms and conditions imposed in the preceding fiscal year. If this section is in effect at the end of a fiscal year, funding levels continue into the next fiscal year. Expenditures and obligations made under this section will be charged to the appropriate appropriation when a regular appropriation bill becomes law. Section 9502(d)(1)(A) of the Internal Revenue Code of 1986 is amended to include the Aviation Funding Stability Act of 2025. This section does not apply if another provision of law provides for the program, project, or activity.
