The SNWA is granted this right-of-way without the payment of rents or other charges. The SNWA may excavate and use or dispose of materials from the pipeline construction without consideration. The Secretary of the Interior and the SNWA must enter into a memorandum of understanding regarding disposal of materials. The right-of-way is subject to requirements to protect Conservation Area resources and prevent adverse impacts to surface resources. Existing utility corridors and rights-of-way are preserved, allowing for continued operation and maintenance of existing facilities. The expansion of the Conservation Area boundary does not preclude the establishment of new utility facilities within existing corridors, subject to environmental review and Secretary approval.
