The disclosure must state, 'This price was set by an algorithm using your personal data' and be prominently displayed. Consumers have the right to opt-out of personalized algorithmic pricing and receive a price without it. Covered persons are prohibited from discriminating against consumers who opt-out. Covered persons must notify the Federal Trade Commission when starting or stopping the use of personalized algorithmic pricing. Certain services and products, including insurance, credit, and dynamic pricing (without personal data), are exempt. Discounts for specific groups (teachers, veterans, etc.) and pricing based on delivery distance are also exempt. The Federal Trade Commission will establish a method for reporting violations within one year of the Act's enactment. The Federal Trade Commission has enforcement authority under the Federal Trade Commission Act. State attorneys general can bring civil actions on behalf of residents if they believe state interests are threatened.
