What does EARNED WAGE ACCESS SERVICES. of Earned Wage Access Consumer Protection Act do?

This section establishes requirements for earned wage access services. Earned wage access providers must offer a no-cost option for consumers to receive earned wages. Providers are required to disclose various limits on access, fees, and how consumers can obtain wages without fees. Disclosures must be provided before entering an agreement, before disbursement, and ongoing regarding fees and tips. Providers cannot solicit tips that imply they will impact the amount or frequency of wage access. Providers must notify consumers of material changes to terms and conditions. Consumers have the right to discontinue services without financial penalty. Providers must establish procedures to address consumer complaints. Providers may not seek payment for disbursed wages through civil suits, arbitration, or debt collection. Providers must reimburse consumers for overdraft or NSF fees resulting from early wage withdrawals. Providers may not share fees or tips with the consumer's employer. Discrimination based on protected characteristics is prohibited. The Bureau of Consumer Financial Protection will issue rules to carry out the Act within 180 days of enactment. Earned wage access services and related fees/tips are not considered credit or loans under federal law.
