What does REQUIRING ELECTROCARDIOGRAMS AND ECHOCARDIOGRAMS FOR HIGH of Marcus’s Law do?

This section requires local educational agencies (LEAs) receiving funds under an applicable program to provide medical screening (electrocardiogram and echocardiogram) for students in grades 9 through 12 before their first participation in an athletic contest. The screening must occur between the first day of the school year when a student enters grade 9 and one day before their first athletic contest. LEAs must establish partnerships with public or private entities to offer these screenings at a cost of $20 or less per student, by the first day of the first sports season after enactment. If an LEA cannot establish a partnership, it can request a waiver from the Secretary by demonstrating attempts to do so. The Secretary will determine if sufficient attempts were made and may waive the requirement for a sports season. LEAs receiving a waiver must attempt to establish a partnership for the following sports season. Religious beliefs or a physician's documentation can provide exemptions from the medical screening requirement. The term 'applicable program' is defined by section 400(c) of the General Education Provisions Act. ’Athletic contest’ is defined as a competitive event where athletes or teams compete on behalf of a secondary school. ’Local educational agency’ and ‘parent’ have the meanings given in section 8101 of the Elementary and Secondary Education Act of 1965.
