It establishes a civil right of action for individuals who receive intimate visual depictions without consent, if the transmission affects interstate or foreign commerce. Legal guardians can bring civil actions on behalf of individuals under 18, incompetent, or incapacitated individuals who receive such depictions. Plaintiffs in civil actions involving minors can elect to use initials or a pseudonym to protect their privacy. Transmissions for good faith medical, educational, or law enforcement purposes are exempt from this civil action. Individuals bringing a successful civil action may receive statutory damages of up to $1,000, compensatory damages for emotional distress, and injunctive relief. This section does not modify existing criminal laws. The section includes a rule of construction stating it should not abridge First Amendment rights. If any part of this section is deemed unconstitutional, the remaining parts remain in effect.
