What does PROHIBITION ON USE OF CAMPAIGN FUNDS FOR CERTAIN FINANCIAL of Campaign Funds Integrity Act of 2026 do?

This section amends Section 324 of the Federal Election Campaign Act of 1971 to prohibit the use of campaign funds for participation in prediction markets or event contracts. These contracts are defined as those whose value is derived from the outcome of an election, legislative action, regulatory decision, or other political or economic event. Violations of this section are subject to enforcement procedures and civil penalties under Section 309. Knowing and willful violations may result in criminal penalties, including fines and imprisonment of up to 5 years. The Federal Election Commission (FEC) can refer apparent knowing and willful violations to the U.S. Department of Justice for criminal prosecution. The FEC is required to promulgate regulations to implement this section, including guidance on permissible financial instruments. The prohibition does not extend to deposits in insured depository institutions, investments in diversified mutual funds or exchange-traded funds, or other low-risk financial instruments permitted by the Commission. Campaign funds are defined as contributions or donations received by a candidate, authorized committee, or other political committee. This section and the amendment it makes will take effect 120 days after the date of enactment of this Act.
