This section establishes the Veteran Scam Victims Foundation under Title 38 of the United States Code, following chapter 83. The Foundation is a charitable and nonprofit corporation, not an agency of the United States, and is subject to the District of Columbia Nonprofit Corporation Act. The Foundation's purposes include encouraging private gifts to prevent veterans from becoming victims of scams and undertaking activities to educate and support veterans affected by scams. The Foundation is prohibited from providing compensation to veterans for monetary losses due to scams. The Foundation will be governed by a Board composed of representatives from various agencies, including the Department of Veterans Affairs, the Department of Commerce, the Department of Defense, the Department of Justice, the Federal Trade Commission, the Internal Revenue Service, and the Social Security Administration. The Foundation has the authority to accept gifts, devises, or bequests and may utilize services and facilities of the Department of Veterans Affairs. The Foundation is exempt from federal, state, and local taxation. The Foundation must submit an annual report to the appropriate congressional committees detailing its proceedings, receipts, expenditures, and investments.
