What does CLEAN AIR ACT PENALTY ENHANCEMENT. of Make DTE Pay Act do?

This section amends Section 120(b) of the Clean Air Act. Paragraph (8) of Section 120(b) is modified by removing 'and' after the semicolon. Paragraph (9) of Section 120(b) is modified by removing '(d)(4).' and inserting '(d)(4); and'. A new paragraph (10) is added to Section 120(b). This new paragraph (10) establishes a penalty adjustment for noncomplying stationary sources owned or operated by investor-owned electric or gas utilities. The penalty amount is increased by an amount equal to the original assessment for each rate increase the utility received in the 2-year period preceding the original assessment. The penalty amount is also increased by an amount equal to the original assessment for each rate increase the utility seeks in the 2-year period following the original assessment, regardless of approval status.
