This section amends Section 107(d)(4)(A) of the Clean Air Act. It allows an ozone nonattainment area to be redesignated as an attainment area if a State demonstrates that the area would have met the ozone standard but for emissions from outside the State. The Governor can submit the finding and demonstration to the Administrator at any time. The Administrator must concur or nonconcur within 180 days of submission. If the Administrator concurs, they must promulgate the redesignation. The Governor and Administrator must consider modeling or monitoring evidence of emissions from other States and foreign countries when making a finding.
