This section establishes conditions on the appointment of monitors by district courts to oversee the conduct of state or local governments. The Director of the Administrative Office of the United States Courts must create rules within 180 days of the section's effective date to govern these appointments. Monitors are limited in the fees they can charge, with the Administrator setting maximum rates, and are encouraged to use pro bono or reduced rates. A monitor cannot hold more than one monitorship simultaneously, serve for more than five years, or be reappointed immediately after their term expires. Subsequent monitors appointed under the same court order cannot be employed by the same entity as the previous monitor. Courts must provide public notice and allow for public comment before appointing a monitor. Revisions to a monitorship require a hearing and can only occur if the subject of the monitorship has not achieved substantial and sustained compliance. Six years after a monitorship order, the case must be transferred to another judge in the district. Monitors must submit annual accountings to the court detailing services and fees, and these accountings must be made publicly available. If a monitorship is already in effect upon enactment and has lasted six years, a new monitor must be appointed within 180 days and the case transferred within one year, adhering to the new limitations.
