What does INITIAL LICENSE REVIEW. of Protecting American Competition Act of 2026 do?

This section amends the Export Control Reform Act of 2018 to establish a process for initial license reviews. The Under Secretary for Industry and Security must consider if a requested license is the first for a specific item to a consignee or end user. Subsequent applications for similar items to the same consignee or end user should be processed in a timely manner. The Under Secretary must submit an annual report to Congress detailing initial licenses granted and related applications. The report to Congress includes the number of initial licenses, details of those licenses and related applications, and the reasons for issuing an initial license. The Under Secretary is not required to delay licensing decisions or act contrary to national security or foreign policy interests. The 'appropriate congressional committees' are defined as the Committee on Foreign Affairs of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate. The Under Secretary must submit a report to Congress within 90 days of the Act's enactment detailing implementation of the new subsection (f)(2).
