This section amends Title I of the Foreign Intelligence Surveillance Act of 1978 by establishing a FISA Oversight Office within the Department of Justice. The FISA Oversight Office will evaluate applications under the Foreign Intelligence Surveillance Act. If the Office determines probable cause may not be met, it may petition to be joined as a party or file a motion with the court. When an application involves a United States person and probable cause is not clearly met, the Office must petition and file a motion. The Federal office filing the application must provide the Office all available evidence pertaining to investigations of United States persons and notify the Office when an application is filed. The Attorney General and the Director must submit a report to Congress within 365 days detailing the number of applications challenged and declined, along with information about the subjects and information sought.
