What does SHORT TITLE. of CHATBOT Act do?

This bill is formally titled the Curbing Harmful AI Tools By Offering Transparency Act, also known as the CHATBOT Act.

What does AI CHATBOT TRANSPARENCY. of CHATBOT Act do?

This section prohibits covered entities from deploying AI chatbots that falsely imply possession of a professional license or that falsely indicate human verification of output by a licensed professional. The term 'imply' is defined to include representations a reasonable user would understand as claiming licensure, but excludes general information or procedural guidance. The Federal Trade Commission (FTC) will provide guidance on complying with these requirements within 12 months of enactment. The FTC has authority to enforce this section as a violation of unfair or deceptive acts or practices under the Federal Trade Commission Act. State attorneys general can bring civil actions on behalf of residents if they believe state interests are threatened, seeking injunctive relief, damages, and other legal remedies. If the FTC or the Attorney General of the United States initiates a civil action, states cannot bring a similar action against the same defendant for the same violation during the federal action's pendency. Individuals injured by violations can bring a private right of action against the violating entity, seeking injunctive relief and damages. Civil penalties and damages are subject to adjustment for inflation based on the Consumer Price Index. The term 'covered entity' is defined as an individual or company that deploys an AI chatbot. Covered professions include those in the finance, healthcare, legal, and accounting sectors.
