This section establishes a new category of nonimmigrant visas for "family purposes" under Section 101(a)(15)(B) of the Immigration and Nationality Act. To be eligible for a family purpose visa, a relative must have a sponsor submit a declaration of financial support, obtain travel medical insurance, and affirm their intent to depart the United States within 90 days. The period of authorized admission for a family purpose visa is limited to 90 days per calendar year. Individuals who previously petitioned for a relative who overstayed their authorized admission period may be restricted from petitioning for new family purpose visas. The Secretary of Homeland Security may waive certain inadmissibility restrictions based on overstays due to extraordinary circumstances. Section 248(a)(1) of the Immigration and Nationality Act is amended to include aliens classified as nonimmigrants under subparagraph (B)(iii) of section 101(a)(15).
