What does EXEMPTION OF QUALIFIED CHARITABLE ORGANIZATIONS FROM REGULATION of CFTC Charitable Organization Exemption Act of 2025 do?

This section amends Section 4m of the Commodity Exchange Act to clarify exemptions from regulation as commodity pool operators. One exemption applies to charitable organizations defined in section 3(c)(10)(D) of the Investment Company Act of 1940. The exemption for charitable organizations applies to their advisory or pool activities conducted only on behalf of charitable organizations or excluded investment enterprises. Another exemption applies to commodity trading advisors who have not advised more than 15 persons in the preceding 12 months. Commodity trading advisors registered with the Securities and Exchange Commission as investment advisors may also be exempt under certain conditions. Persons exempted under paragraphs (1) and (2) are subject to proceedings under section 14.
