SUPPLY REDUCTION ACTIVITIES AND CONTINUATION OF THE OFFICE OF NATIONAL DRUG
CONTROL POLICY.
It is the sense of Congress that--
(1) the second budget submitted by the President to the Congress under
section 1105 of title 31, United States Code, after the date of enactment
of this Act should provide for the funding of activities to reduce the
demand for drugs (including anti-drug education programs and treatment)
in an aggregate amount that is equal to the aggregate amount of funding
for activities to reduce the supply of drugs (including law enforcement
uses, law enforcement grants, border control and customs efforts, prison
construction and maintenance, and international eradication efforts;
(2) the Director of National Drug Control Policy should be assigned authority
to implement and oversee the distribution of funds for drug demand and
drug supply reduction activities in accordance with paragraph (1); and
(3) section 1009 of the Anti-Drug Abuse Act of 1988 (21 U.S.C. 1506) should
be amended to continue the existence of the Office of National Drug Control
Policy beyond the current termination date of November 18, 1993.

a nonsmoking policy that meets or exceeds the requirements of subsection (b).
(b) NONSMOKING POLICY- A nonsmoking policy meets the requirements of this
subsection if such policy prohibits smoking in each portion of an indoor
facility used in connection with the provision of children's services, and,
where appropriate, such policy requires that signs reading `no smoking'
be posted in each such facility to communicate the policy. Such policy
may allow smoking in those portions of the facility--
(1) in which such services are not normally provided directly to children;
and
(2) that are ventilated separately from those portions of the facility in
which such services are normally provided directly to children.
(c) WAIVER- A person described in subsection (a) may publicly petition in
writing the Federal agency from which the person receives Federal funds
or financial assistance for a waiver of the requirements of subsection
(b). A waiver may be granted, after an opportunity for public hearing if
practicable or comment, only if the person provides written assurances
satisfactory to the Federal agency that--
(1)(A) unusual extenuating circumstances prevent the person from establishing
or enforcing the nonsmoking policy described in subsection (b) (such as the
person shares space in an indoor facility with another person and cannot
obtain an agreement with the other person to abide by the nonsmoking policy
described in subsection (b)); and
(B) the person will establish and make a good-faith effort to enforce an
alternative nonsmoking policy that will protect children from exposure to
environmental tobacco smoke to the maximum extent possible; or
(2) the person will establish and make a good-faith effort to enforce an
alternative nonsmoking policy that will protect children from exposure to
environmental tobacco smoke to the same degree as the policy described in
subsection (b).
(d) TECHNICAL ASSISTANCE- The Secretary of Health and Human Services
(or a designee of the Secretary) shall provide technical assistance to
Federal agencies and other persons who request such assistance, including--
(1) information on smoking cessation programs for employees; and
(2) information to assist such agencies and persons in complying with
this Act.
(e) DEFINITIONS- As used in this section:
(1) CHILDREN- The term `children' means individuals who have not attained
the age of 5.
(2) CHILDREN'S SERVICES- The term `children's services' means--
(A) direct health services routinely provided to children; or
(B) any other direct services routinely provided primarily to children.
(f) EFFECTIVE DATE- This section shall become effective on October 1,
1992, or the date of enactment of this section, whichever is later.

authorized to be appropriated by this Act or any other Act shall be used
by any recipient of funds under this Act or any other Act to pay for
homosexual educational, counseling, or support services in elementary or
secondary schools, or to promote or encourage, either directly or indirectly,
intravenous drug abuse or homosexual, bi-sexual, or heterosexual activity,
whether pre-marital or extra-marital, in elementary or secondary schools. No
youth shall be deemed at risk of substance abuse, for purposes of funding
under this Act, solely on the basis of the youth's homosexuality.
