What does ADJUSTMENT OF STATUS FOR CERTAIN HAITIAN ORPHANS. of Help HAITI Act of 2010 do?

This section allows the Secretary of Homeland Security to adjust the status of certain Haitian orphans to lawful permanent residents. To be eligible, an alien must have been inspected and granted parole into the United States under the humanitarian parole policy for Haitian orphans announced in 2010. The alien must be physically present in the United States and admissible as an immigrant, except as provided in subsection (c). An application for adjustment of status must be filed within three years of the Act's enactment. The total number of aliens granted permanent residence under this section is limited to 1400. Section 212(a)(7)(A) of the Immigration and Nationality Act, relating to certain criminal grounds of inadmissibility, does not apply to aliens seeking adjustment of status under this section. The Secretary of State is not required to reduce the number of immigrant visas issued due to aliens granted permanent residence under this section. Unmarried aliens under 18 who obtain adjustment of status are deemed to meet the requirements for adopted children under certain provisions of the Immigration and Nationality Act if a U.S. citizen adopted them. Birth parents of aliens who obtain adjustment of status under this section are not granted any rights, privileges, or status under this section or the Immigration and Nationality Act.
