What does VACANCY OF INSPECTOR GENERAL POSITIONS. of Independent Acting IGs Act of 2025 do?

This section amends Section 403(h) of Title 5, United States Code, concerning Inspector General (IG) vacancies. It modifies requirements for the Principal and Deputy Inspectors General to have served for at least 180 days before certain actions can be taken. When an IG position requiring Presidential appointment is vacant, the first assistant to the IG position will serve as the acting IG. If the first assistant is unavailable, an individual will be appointed according to paragraph (5). Paragraph (5) establishes a process where a judge from the relevant circuit court of appeals selects an acting IG. A committee of Inspectors General will recommend candidates to the judge for appointment. The judge has sole authority to appoint an individual to carry out the duties of the IG office until the vacancy is filled. Notwithstanding Section 3347 of Title 5, the amended Section 403(h) applies in the event of an IG vacancy. Section 3(a)(2)(C) of H.R. 7326, as passed by the House of Representatives on December 3, 2024, has the force and effect of law.
