This section amends the Clean Air Act to extend the review intervals for National Ambient Air Quality Standards (NAAQS) from five-year to ten-year intervals. It allows the Administrator to consider the likely attainability of a standard, as a secondary consideration, when establishing or revising NAAQS, in consultation with an independent scientific review committee. It provides states with at least one year, and potentially up to three years, to correct deficiencies before the Administrator promulgates a Federal Implementation Plan (FIP). It exempts nonattainment areas classified as Extreme Areas for ozone from certain contingency measures. It adds 'and economic feasibility' to requirements related to technological achievability in ozone nonattainment area plans. It removes certain reduction percentage requirements from plan submissions and revisions for ozone and particulate matter nonattainment areas. It requires particulate matter nonattainment area plans to consider technological achievability and economic feasibility.

What does EMISSIONS BEYOND CONTROL. of CLEAR Act do?

This section amends the Clean Air Act to include exceptions for exceptional events and actions to mitigate wildfire risk. The term 'exceptional event' is defined to include natural events, human activities that mirror natural events, and human activities that are unlikely to recur. The Administrator must conduct regional modeling and analysis for exceptional events and actions to mitigate wildfire risk upon request by one or more States. A public website will be established to describe the status of all submitted petitions for exceptional events and actions to mitigate wildfire risk. Sanctions and fees may not apply to a State if it demonstrates that emissions from outside the nonattainment area, exceptional events, or mobile sources beyond the State's control prevented attainment of a national ambient air quality standard.

What does CLEAN AIR SCIENTIFIC ADVISORY COMMITTEE. of CLEAR Act do?

This section amends Section 109(d)(2)(A) of the Clean Air Act to increase the number of representatives from State air pollution control agencies on the Clean Air Scientific Advisory Committee from one to three. The three State representatives must be from geographically diverse areas, with at least one from EPA Regions 1, 2, 3, or 5; one from Regions 4, 6, or 7; and one from Regions 8, 9, or 10. This section also adds a new subsection (D) to Section 109(d)(2) of the Clean Air Act. Before establishing or revising a national ambient air quality standard, the Administrator must request the committee to assess and provide advice on any adverse public health, welfare, social, economic, or energy effects resulting from attainment and maintenance strategies.
