If the Commission receives such a notification, it must promptly notify relevant federal agencies, including the Department of Energy and the Environmental Protection Agency. Federal agencies must submit covered agency actions (regulations relating to generation resources) to the Commission for review and comment, either before submission to the Office of Management and Budget or within 90 days of planned public release. The Commission, in consultation with the ERO, will provide comments and recommendations on these actions, assessing their potential impact on rates and reliability. Agencies must respond to the Commission's comments and recommendations before finalizing an action, and the Commission must determine the action won't significantly negatively impact reliability. Agencies must make the Commission's comments, agency responses, and the final action publicly available.
