An 'artificial system' is a data system or software using AI, but excludes common commercial products like word processors. ’Commerce’ is defined broadly, referencing the Labor Management Relations Act of 1947. ’Covered individual’ includes employees and independent contractors. ’Emerging artificial intelligence technology’ refers to systems with performance, complexity, or autonomy comparable to or exceeding state-of-the-art capabilities. ’Employer’ is defined as any entity engaged in commerce who compensates covered individuals.

What does ANTI-RETALIATION PROTECTION FOR AI WHISTLEBLOWERS. of AI Whistleblower Protection Act do?

This section prohibits employers from retaliating against 'covered individuals' for actions related to AI security vulnerabilities or violations. Covered actions include providing information to regulatory officials, Congress, or supervisors, or participating in investigations. Individuals alleging retaliation can file a complaint with the Secretary of Labor or bring a lawsuit in district court. If the Secretary of Labor does not issue a final decision within 180 days, the individual may pursue legal action. Relief for prevailing individuals includes reinstatement, double back pay with interest, compensatory damages (including litigation costs), and other appropriate remedies. Contracts or agreements cannot waive or alter the rights and remedies provided in this section, including those requiring arbitration.
