Employers seeking participation must submit applications and undergo self-evaluations and onsite evaluations by the Secretary of Labor. Onsite evaluations will not result in enforcement citations, but any identified hazards must be corrected within 90 days. Worksite audits and evaluations will be supervised by Occupational Safety and Health Administration employees and special government employees. The Secretary of Labor must develop policies for monitoring program performance and documenting follow-up actions related to fatalities and serious injuries. Approved worksites are exempt from programmed inspections while participating in the Program. The Secretary of Labor is prohibited from requiring payments for employers to qualify for or participate in the Program. The Secretary of Labor must establish a written plan within two years of enactment to modernize technology used to administer the Program, including application processes and self-evaluations.
