This section amends the Public Health Service Act and ERISA to establish requirements for cost-sharing for certain insulin products. For plan years beginning on or after January 1, 2026, group health plans and health insurance issuers shall not apply any deductible or impose cost-sharing exceeding $35 or 25% of the negotiated price for selected insulin products for individuals 26 years of age or younger. “Selected insulin products” includes at least one of each dosage form and type of insulin when available. Cost-sharing payments towards insulin will count towards deductibles and out-of-pocket maximums. The amendments also clarify that these insulin coverage rules should not be considered when determining the actuarial value of a qualified health plan.
