For cylindrical packaging, the symbol and label notice must be visible each time a wipe is dispensed. The label notice must be the phrase 'Do Not Flush'. The symbol is defined as the 'Do Not Flush' symbol from the Association of the Nonwoven Fabrics Industry (INDA) and the European Disposables And Nonwovens Association (EDANA). The Federal Trade Commission (FTC) is responsible for enforcing this section and may promulgate regulations to implement it. State laws regarding 'Do Not Flush' labeling are preempted if they are not identical to the federal requirements. A 'covered product' is a premoistened, nonwoven disposable wipe marketed as a baby wipe or a household/personal care wipe composed of petrochemical-derived fibers with a significant potential to be flushed.
