The Secretary of Veterans Affairs may furnish infertility treatments, standard fertility preservation services, or both, at the election of a covered individual. For in vitro fertilization (IVF) treatment, the Secretary may furnish up to three completed cycles resulting in live birth or 10 attempted cycles, whichever occurs first. The Secretary may furnish IVF treatment using donated gametes or embryos. Consent is required from the covered individual, their partner (if applicable), and any third-party donor before furnishing IVF cycles or other treatments. The Secretary is not required to furnish maternity care beyond what is already required by law. The legal status of gametes or embryos will be determined by state law. The Secretary shall deem a partner of a covered veteran to be a veteran for purposes of beneficiary travel payments. Regulations to carry out section 1720K must be prescribed within one year of the Act's enactment. Individuals receiving counseling and treatment under existing infertility authority may elect to continue under that authority or transition to the new section 1720K.
