What does AUTHORITY TO PREVENT AND ADDRESS INTENTIONAL MISUSE OF of TANF State Expenditure Integrity Act of 2025 do?

This section amends the Social Security Act to provide the Secretary with authority to prevent and address intentional misuse of subrecipient funds under the TANF program. The Secretary is directed to develop a framework for monitoring subrecipient use of funds to identify intentional misuse, supplementing existing state audits. The Secretary may establish state plan requirements and formats related to this monitoring and may require states to report relevant information. A TANF Program Integrity Unit will be created within the Administration for Children & Families to conduct this monitoring. Funding for the Program Integrity Unit is increased by $10,000,000 annually, drawn from funds not otherwise appropriated. The Secretary must submit an annual report to Congress on the activities of the Program Integrity Unit. The enhanced penalty for intentional violations now includes an additional remedy: requiring the state to expend an amount equal to the misused funds on cash assistance to families below the poverty line. The Secretary must publish a notice of rulemaking to implement these amendments within two years of the Act's enactment. The amendments will take effect within two years of the Act's enactment, specifically on the later of the first day of the fifth calendar quarter or the first day of the first federal fiscal year after enactment.
