This section amends Chapter 6 of Title 23 of the United States Code by adding Section 612. Section 612 establishes ineligibility for certain federal funds for political subdivisions of a State that do not comply with notification requirements. The Secretary of Transportation is prohibited from obligating or awarding funds for infrastructure projects to political subdivisions that fail to notify the Secretary of Homeland Security (or designee) within 48 hours of releasing an alien from custody. The notification requirement applies if Homeland Security has determined the alien is not lawfully present and has notified the relevant authorities of the alien’s legal status, and the alien has been in custody for at least 48 hours.
